1. Acceptance of this agreement
This Usage Policy is a binding agreement between you and Sean Esopenko regarding your use of flash-drawing.net (the Service).
By creating an account, uploading content, creating collections, publishing collections, or otherwise using the Service, you agree to this Usage Policy.
If you do not agree, you must not use the Service.
2. Nature of the Service
flash-drawing.net is a non-commercial service intended to help users study drawing through image reference tools. Users may upload images, organize them into collections, and use timed or randomized image display features for activities such as gesture drawing, memory practice, and related personal art study.
The Service is operated on a non-commercial basis. The operator does not represent that the Service is provided as a commercial product, paid platform, or professionally managed content marketplace.
The Service is a personal, community-oriented project and is not operated as a full-service moderated platform. Users must not treat the operator as responsible for routine content sorting, labeling, review, or cleanup. If misuse, moderation demands, legal risk, or operational burden become unreasonable, the operator may restrict features, remove content, suspend accounts, or discontinue the Service.
3. Eligibility and account requirements
To upload images or create collections, you must register for an account.
To publish collections, you must verify your email address.
You are responsible for maintaining the security of your account and for all activity that occurs under your account.
4. Personal use only
You agree to use the Service only for your own personal, non-commercial use.
You must not use the Service to operate a business, run a commercial content library, provide paid access to content, resell access to the Service, or otherwise use the Service for commercial exploitation.
You must not use the Service in a way that creates unreasonable legal, operational, moderation, storage, bandwidth, or compliance burdens for the operator, including by repeatedly mislabeling content or relying on the operator to correct, sort, or review your uploads.
5. Private and published content
Images uploaded to the Service are private by default.
Collections created on the Service are private by default.
A collection becomes publicly viewable only if you choose to publish it.
Published collections may be viewed by unauthenticated users.
You are solely responsible for deciding whether to publish a collection and for ensuring that any published collection complies with this Usage Policy.
6. User-submitted content
The Service hosts user-submitted content. The operator does not pre-screen every image or collection before it is uploaded or published.
You acknowledge and agree that:
- content available through the Service may be uploaded by users;
- the operator may use reasonable and discretionary measures to detect, deter, review, remove, or report unlawful, infringing, harmful, offensive, or otherwise prohibited content, but does not guarantee that such content will be prevented, detected, reviewed, or removed before exposure;
- the operator is not responsible for reviewing, classifying, relabeling, or correcting user content on a user's behalf;
- users are expected to classify and manage their own content responsibly;
- your use of the Service is at your own risk; and
- the operator may investigate, restrict, remove, preserve, disclose, report, relabel, or reclassify content where reasonably necessary to enforce this Usage Policy, protect users, comply with law, or assist law enforcement.
7. Your responsibility for uploaded content
You are solely responsible for all images, collections, titles, descriptions, tags, and other content that you upload, create, store, or publish through the Service.
You represent and warrant that:
- you have the right to upload and use the content you submit;
- your content and use of the Service will comply with applicable law, including Canadian law;
- your content will not violate the rights of any person, including privacy rights, intellectual property rights, or other legal rights;
- your content and use of the Service must not be used to target, harass, threaten, expose, or endanger any person;
- you are responsible for correctly labeling your uploaded images and collections as Safe or NSFW in accordance with the Service's content rating rules;
- any collection you publish as safe for work does not contain NSFW content; and
- you will not upload, publish, or share content that would be classified as Adult or 18+ content under the Service's content rating rules.
8. Prohibited content and conduct
You must not upload, create, publish, share, or otherwise use the Service for content or conduct that is unlawful, abusive, or prohibited by this Usage Policy.
This includes, without limitation:
8.1 Illegal sexual content involving minors
You must not use the Service for any child sexual abuse material, child sexual exploitation material, or any sexualized, exploitative, abusive, or otherwise unlawful content involving minors.
Any content that may constitute illegal content involving minors, including content that may violate Canadian law, is strictly prohibited.
8.2 Adult / 18+ content is prohibited
flash-drawing.net supports only two allowed content ratings for user content: Safe and NSFW.
Content that would be classified as Adult or 18+ is not permitted on the Service.
For purposes of this Usage Policy, Adult / 18+ content includes explicit adult sexual content, including for example:
- explicit nudity;
- visible genitals;
- explicit sexual activity;
- masturbation;
- pornographic presentation;
- explicit fetish content; or
- other content intended primarily as explicit adult sexual material.
Adult / 18+ content is prohibited whether it is stored privately, included in a private collection, included in a published collection, or otherwise made available through the Service.
8.3 Other unlawful content
You must not upload or publish content that is illegal to possess, distribute, make available, or access under applicable law, including Canadian law.
8.4 Safe-for-work publication rule
If you publish a collection that is designated or treated as safe for work, that collection must not contain NSFW content.
8.5 Harassment, targeted abuse, and unauthorized disclosure of personal information
You must not use the Service to harass, threaten, intimidate, target, or abuse any person or group. This includes, for example:
- posting, uploading, or sharing another person's private, personal, identifying, or sensitive information without authorization;
- using the Service to encourage, organize, or direct harassment, coordinated abuse, or disruptive activity against any person, group, platform, website, or community; or
- using images, collections, titles, descriptions, or tags to target, shame, threaten, or endanger others.
8.6 Evasion, abuse, and interference
You must not:
- attempt to evade moderation, reporting, detection, or enforcement mechanisms;
- use false information to register or verify accounts;
- interfere with the Service or its security features;
- scrape, harvest, mirror, overload, or abuse the Service; or
- use the Service in a way that may expose the operator or other users to unreasonable risk.
9. NSFW functionality
The Service may permit users to enable an NSFW preference.
NSFW content is content that is not necessarily illegal or explicit adult sexual content, but may be inappropriate for viewing in workplaces, schools, public settings, or around others. This may include, for example, underwear, lingerie, bikinis or swimwear, revealing clothing, partial nudity, suggestive poses, and non-explicit artistic nudity.
A separate policy may govern NSFW participation, content, or access. That separate policy is not included here.
If you enable NSFW functionality, you remain fully responsible for complying with all applicable rules and laws. Nothing in the availability of NSFW settings permits illegal content or Adult / 18+ content.
10. Detection, fingerprinting, preservation, and reporting
To help detect, deter, investigate, and report illegal or prohibited content, the Service may use technical measures including image fingerprinting.
By using the Service, you acknowledge and agree that:
- images uploaded to the Service may be fingerprinted;
- fingerprinting methods, records, logs, and related documentation may be maintained, archived, and preserved;
- such records may make it possible to verify that an image was uploaded, stored, or shared through the Service even after the original image is deleted; and
- the operator may preserve and disclose relevant records, technical data, and other information to law enforcement or other authorities where the operator believes it is necessary or appropriate.
The Service also provides a reporting system for suspected illegal or prohibited content. Reporting may be made without registration or authentication.
11. No guarantee of complete prevention
The operator may use reasonable and discretionary measures to reduce illegal and prohibited content, including fingerprinting and user reporting, but does not guarantee that such content will never appear on the Service.
You acknowledge that no screening, moderation, or technical detection system is perfect.
12. Investigations and enforcement
The operator may, but is not obligated to, in the operator’s sole discretion and without prior notice:
- review content or account activity;
- restrict or suspend access to the Service;
- unpublish or remove collections;
- relabel or reclassify content;
- remove or disable access to images or accounts;
- preserve evidence and account information; and
- report conduct or content to law enforcement or other authorities.
The operator may take these actions where content or conduct appears to violate this Usage Policy, applicable law, or the safety and integrity of the Service.
13. Deletion does not guarantee eradication
If content is deleted by you or by the operator, copies, logs, backups, fingerprints, audit records, or other technical records may remain for security, legal, moderation, evidentiary, or operational purposes.
You must not assume that deletion permanently removes all evidence of upload, access, or sharing.
14. Intellectual property and permissions
You must not upload, publish, or distribute content unless you have the necessary rights or permissions to do so.
The operator does not claim ownership of your content solely because you upload it to the Service. However, by uploading content, you grant the operator the limited rights reasonably necessary to host, store, process, display, transmit, moderate, review, and enforce rules relating to that content as part of operating the Service.
15. Service availability and no warranty
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by applicable law, the operator makes no warranties, representations, or guarantees about availability, reliability, fitness for a particular purpose, accuracy, security, moderation outcomes, or uninterrupted access.
The Service may be changed, restricted, interrupted, or discontinued at any time.
16. Limitation of liability
To the maximum extent permitted by applicable law, Sean Esopenko will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, content, goodwill, opportunity, or profits, arising out of or related to the Service or this Usage Policy.
To the maximum extent permitted by applicable law, the operator’s total liability arising out of or relating to the Service will not exceed the greater of:
- CAD $50; or
- the amount you paid to the operator for use of the Service in the 12 months before the claim.
Because the Service is non-commercial and provided for personal use without paid access, you acknowledge that these limitations are a fundamental part of the basis on which the Service is made available.
17. Indemnity
You agree to indemnify, defend, and hold harmless Sean Esopenko from and against claims, demands, proceedings, liabilities, damages, losses, penalties, costs, and expenses, including reasonable legal costs, arising out of or related to:
- your content;
- your use or misuse of the Service;
- your breach of this Usage Policy; or
- your violation of any law or the rights of any person.
18. Termination
The operator may terminate or suspend your access to the Service at any time, with or without notice, if the operator believes you have violated this Usage Policy, created risk, or used the Service inappropriately.
You may stop using the Service at any time.
Sections that by their nature should survive termination will continue to apply, including sections relating to enforcement, preservation, reporting, liability limitations, indemnity, and legal compliance.
19. Changes to this Usage Policy
The operator may update this Usage Policy from time to time by posting an updated version on the Service.
Your continued use of the Service after an updated Usage Policy becomes effective constitutes acceptance of the revised policy.
20. Governing law
This Usage Policy is governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict of law rules.
You agree that any dispute arising out of or relating to this Usage Policy or the Service will be brought exclusively in the courts located in Alberta, Canada, unless applicable law requires otherwise.
